General terms and conditions of Transportation Services
1. Elegant Enterprises quotes are given on the basis of the most direct route and based on the information given by the hirer. Our company gives its advice on journey time in good faith. However, as a result of traffic congestion, or other events beyond the reasonable control of the company, journeys may take longer than predicted and in those circumstances, the company will not be liable for any loss or inconvenience suffered by the client as a result. Quotations are valid for 14 days from issue unless some other period is specified. Unless otherwise stated vehicles parking charges are not included in the quoted rates and the hirer agrees to pay such charges.
2. Our company will not accept any liability for damage, injury or loss for any passenger standing up or walking around the vehicle whilst in motion.
3. Elegant Enterprises reserves the right to supply a larger vehicle than that ordered for any journey, as such no additional charge shall be made unless the additional seating capacity is utilized. Should the vehicle be detained by the hirer or taken on a longer journey than that contracted for, Elegant Enterprises reserves the right to make an additional charge.
4. Customer cannot assume the use of the vehicle between outward and return journeys, nor that will it remain at the destination of the customer use unless this has been agreed with the company in advance.
5. Elegant Enterprises reserves the right to substitute other operators’ vehicles in place of its own for any journey or part thereof providing same contracted conditions are granted.
6. No passenger may be carried in excess of the seating capacity of the vehicle including children and infants regardless their age, they must be included in the total number of passengers available on board and all passengers must wear the seat belts provided at all times. While we are able to supply child seats, we are unable to accommodate disabled passengers.
Consumption of food and alcohol on board of the company’s vehicles are strictly forbidden. Moreover, our company operates a non-smoking vehicle, this policy will be strictly enforced.
No animal may be carried on any vehicle without prior written agreement from Elegant Enterprises. No poster or notice to be displayed on any vehicle without the written consent of the Company.
All vehicles owned and operated by Elegant Enterprises are subject to restrictions on carrying luggage for statutory safety reasons. The hirer accepts that the driver be the sole judge as to whether and to what extent passengers’ property is carried. Large bulky luggage may not be able to be carried. One peace of luggage of 23 kg and a hand bag of 10 kg per adult passenger will be admitted. Elegant Enterprises reserves the right to lower the luggage allowance per passenger at sole discretion should this be required in order to not overload the vehicle and thus comply with road safety regulations.
7. The contracted hours of operation for the driver are regulated by law and the customer accepts the responsibility of ensuring not to exceed it. Neither the customer nor any passenger shall delay or otherwise interrupt the journey in such a way that the driver is at risk of breaching regulations relating to driving hours and duty time. If any breach is likely to occur, the customer will be fully responsible for any additional costs incurred.
8. Elegant Enterprises driver is responsible for the safety of the vehicle at all times and as such may remove any passenger whose behavior prejudices safety. The customer is responsible for any damage caused to the vehicle by any passenger for the duration of the hire. Should any passenger be removed from the vehicle due to their behavior, such passenger shall not be entitled to any refund from Elegant Enterprises.
9. The following cancellation policy will apply:
a) Customer may modify the itinerary / vehicle request up to 15 days before the start of the tour free of charges, modification, cancellation received 14-10 working days prior to the first day of the hire will be subject to 25 percent cancellation charges of the total request invoice.
b) Cancellation received less than 09-03 working days prior to the first day of the hire will be subject to 50 percent cancellation charges of the total request invoice.
c) Cancellation received 02 -00 prior to working day, or the vehicle has departed our premises will be subject to 100 percent cancellation charges of the total request invoice.
10. Elegant Enterprises reserve the right to impose additional charges following completion of the hire if the passengers have left the vehicle in an unreasonably untidy condition or having required additional time or mileage which was not included for in the original booking.
11. For airport or station or ports transfers the vehicle will wait for one hour after the prearranged collection time free of charge. After that additional waiting time will be charged at the discretion of the company.
12. Elegant Enterprises will not be responsible for any damage to, or loss of, personal property left in vehicles, howsoever caused.
13. Acceptance of our quotations implies acceptance of the above terms and conditions.
14. Payment Terms.
Elegant Enterprises accept payment by all major credit cards ( against an administration fees ) or by bank transfers to Raiffeisen Bank who’s details as indicated into our company invoice at the time of reservation within a maximum of 72 hours from the date of our invoice and prior the start of the hire. No credit facilities will be provided unless mutually agreed. The company reserves the right to decline to execute any work when the foregoing condition has not been adhered to.
15. Complaint procedure and conditions.
All complaints should be submitted in writing by letter or email format addressed to Elegant Enterprises Kft, within 48 hours of the completion of the vehicle hire. Elegant Enterprises will respond to every complaint within 08 working days from the receipt of the complaint. The liability of the Company will be limited to the cost of the hire and any ancillary services supplied.
16. Data protection.
Elegant Enterprises will not disclose any customer data obtained through reservation to a third party in any form. However, Elegant Enterprises cannot guarantee protection against hardware or software failure and other factors that may compromise the security of data. Any customer data obtained will be kept into our records only as long as required by the relevant laws and regulations set by the Hungarian authorities.
